Rosemary and her late husband, Connie M. “C.M.” McCormick, lived adjacent to the National Cemetery in their residence at 122 Marine Street. C.M. was not at home on the evening of the murder, according to statements filed with police.

Rosemary was interviewed by city police on the day of the murder, the sheriff’s office and by FDLE Special Agents Dallas Herring and Joe Uebelher on February 14, 1974.

Rosemary told the agents that when she heard the screams at the moment that Athalia was being murdered, she was in the kitchen and her son Locke was in the den watching television. Locke was home from Daytona Community College that day for the purpose of practicing for a play, according to the report.

Rosemary stated that Locke also heard the screams, went out the front door to see what was going on, and walked approximately 8 to 10 feet from the McCormick’s front door; seeing Athalia Lindsley’s body on the front door step of the Lindsley home.

According to Rosemary’s statement to the FDLE agents that day, Locke told her that while he was outside, he observed a white male subject, wearing a white long-sleeved dress shirt, dark trousers, whose hair was light brown, graying and of closely trimmed appearance and that he was walking around the Lindsley residence.

Rosemary told Agents Herring and Uebelher that she went to Mrs. Lindsley’s front gate where she saw Athalia’s body on the front steps and where she met Mrs. Alan (Patti) Stanford. Mrs. Stanford came from the direction of the front of her residence at 126 Marine Street. They spoke to each other very briefly while Locke called the police and ambulance. According to her statement, Rosemary immediately returned to her residence and stayed inside.

In this February 14th interview, Rosemary stated that Locke told her that he had told the editor of the St. Augustine Record, A. H. “Hoop” Tebault, Jr., that at first he thought the assailant was Mr. Stanford, however, Locke now thought that the assailant was heavier than Mr. Stanford and that he could not positively identify the assailant as being Mr. Stanford.
